Trader subjected to sodomy by police

FAISALABAD: Mohammad Usman has been subjected to sodomy, chilies inserted in his anal coupled with severe torture on the alleged direction of the assistant commissioner of Chak Jhumra.

The district standing medical board confirmed that sodomy had been done and victim was also subjected to torture.

However, ignoring the board investigation, the police cancelled the case taking advantage of the DNA report that mentioned no semen had been found in the swabs produced by police.

A Forensic expert says DNA is not mandatory to prove sodomy as it is helpful to determine the accused.

On Nov 16 last, Jhumra police had registered a case against AC Jhumra Qaiser Abbas Rind, theN Chak Jhumra SHO inspector Afzal Lali, a town officer Mohammad Shahbaz and 37 other policemen and employees of the TMA for subjecting Usman to sodomy and brutal
torture.

The police had illegally detained Usman and his younger brother Rehman and brother-in-law Tahir at a private place for two days. The case has been registered almost four months after the incident on the direction of Additional District and Sessions Judge Muhammad Anwarul Haq.

The victim said a senior district government officer had been influencing the police to dispense justice due to which the police had cancelled the case few days after issuance of the DNA report. He said we had produced videos to the police officers that police had stormed into their house and subjected them to torture publicly before taking them to the police station.

He said first the district government officer influenced the police to refrain from registering the case, however, police had to register the case three months after the incident. He said case had been registered on the direction of court.

Usman said police were claiming that case was fake as the DNA report has not detected any semen. He said even after DNA report the standing board clearly mentioned that sodomy had been committed.

The forensic lab in its report issued on Dec 12 last and produced by sub-inspector Manzoor Ahmed after two months mentioned; ''No semen material identified. Therefore no further DNA analysis was conducted on these items.''

The standing board after receiving the report giving its finding said; ''Based upon initial MLC findings, report of Punjab Forensic Science Agency, Lahore, the opinion of DSMB remains the same as original; "The act of unnatural sexual act/sodomy have been committed
on this person (Usman)."

The Punjab Medical College, head of forensic medicine, Dr Khurram Sohail Raja told police could not cancel the case following DNA report. He said injuries of the victim were enough to prove that he had been subjected to sodomy.

He said detection of semen through DNA was not possible if the victim had passed stool and washed his cloths.

Quoting an example of sodomy, he said if a criminal subject a minor boy to unnatural offence and would not ejaculate, it did not mean that sodomy had not been conducted.

Usman said the board had asked the SHO Jhumra in writing on Aug 5,2013 to depute a man for collection of samples required for DNA. However, he said police did not bother to collect samples.

The board had sent another letter on Nov 20,2013 to the SHO for samples collection.

He said police had sent samples after delay of more than three months.

Although the police have cancelled the case, why the challan is not being submitted to the court even after passing of 14 months.

He said we had repeatedly requested the police to submit challan so that they could fight for justice.

The police station officials said the case had been cancelled and they would not submit the challan.
